About our privacy policy

Shades Concepts cares a great deal about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Shades Concepts. The effective date for the validity of these terms and conditions is day/month/year, and the publication of a new version invalidates all previous versions. This privacy policy describes what data about you is collected by us, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have with regard to the personal data you provide to us.

Webshop software

Shopify

Our webshop is developed with Shopify software. Personal data that you make available to us for our services will be shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Shopify is obliged, based on the agreement we have with them, to take appropriate security measures. These security measures consist of applying SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve its services. Shopify observes the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, and your data may be processed in the United States.

Email and mailing lists

MailBlue

Our website uses MailBlue, a third party that handles email traffic originating from our website and the sending of any newsletters. All confirmation emails you receive from our website and web forms are sent via MailBlue's servers. MailBlue will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website, you will see an 'unsubscribe' link. If you click on it, you will no longer receive emails from our website. This can severely impair the functionality of our website! Your personal data is securely stored by MailBlue. MailBlue uses cookies and other internet technologies that make it clear whether emails are opened and read. MailBlue reserves the right to use your data to further improve its services and to share information with third parties in this context.

Office365

We use the services of Office365 for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Office365 does not have access to our mailbox, and we treat all our email traffic confidentially.

Payment processors

Pay.nl

For processing (part of) the payments in our webshop, we use the Payment Service Provider Pay.nl. Pay.nl processes your name, address, and residence details, and your payment details such as your bank account or credit card number. Pay.nl has taken appropriate technical and organizational measures to protect your personal data. Pay.nl reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. In the case of an application for deferred payment (credit facility), Pay.nl shares personal data and order data with deferred payment service providers. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Pay.nl's services for which it engages third parties. Pay.nl does not store your data longer than permitted by legal retention periods.

Mollie

For processing (part of) the payments in our webshop, we use the Mollie platform. Mollie processes your name, address, and residence details, and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie's services for which it engages third parties. Klarna

For processing (part of) the payments in our webshop, we use the Klarna platform. Klarna processes your name, address, and residence details, and your payment details such as your bank account or credit card number. Klarna has taken appropriate technical and organizational measures to protect your personal data. Klarna reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. In the case of an application for deferred payment (credit facility), Klarna shares personal data and information regarding your financial position with credit rating agencies. Reviews

WebwinkelKeur

We collect reviews through the WebwinkelKeur platform. If you leave a review via WebwinkelKeur, you are required to provide a name and email address. WebwinkelKeur shares this data with us so that we can link the review to your order. WebwinkelKeur also publishes your name on its own website. In some cases, WebwinkelKeur may contact you to provide an explanation for your review. In the event that we invite you to leave a review, we share your name and email address with WebwinkelKeur. They use this data solely for the purpose of inviting you to leave a review. WebwinkelKeur has taken appropriate technical and organizational measures to protect your personal data. Shipping and logistics

PostNL

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of PostNL for deliveries. It is therefore necessary for us to share your name, address, and residence details with PostNL. PostNL uses this data only for the purpose of fulfilling the agreement. In the event that PostNL engages subcontractors, PostNL will also make your data available to these parties.

DHL

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of DHL for deliveries. It is therefore necessary for us to share your name, address, and residence details with DHL. DHL uses this data only for the purpose of fulfilling the agreement. In the event that DHL engages subcontractors, DHL will also make your data available to these parties.

GLS

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of GLS for deliveries. It is therefore necessary for us to share your name, address, and residence details with GLS. GLS uses this data only for the purpose of fulfilling the agreement. In the event that GLS engages subcontractors, GLS will also make your data available to these parties.

Invoicing and accounting

For our administration and accounting, we use the services of Exact online. We share your name, address, and residence details, and details related to your order. This data is used for administering sales invoices. Your personal data is transmitted and stored securely. Exact online is obligated to secrecy and will treat your data confidentially. Exact online does not use your personal data for purposes other than those described above.

External sales channels

Facebook

We sell (a portion of) our items via the Facebook platform. If you place an order through this platform, Facebook shares your order and personal data with us. We use this data to process your order. We also use the Facebook pixel to create customized advertisements. We may also use email address uploads for audience targeting. We handle your data with great confidentiality and have taken appropriate technical and organizational measures to protect your data against loss and unauthorized use.

Purpose of data processing

General purpose of processing

We use your data exclusively for our services. This means that the purpose of processing is always directly related to the task you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time – other than at your request – we will ask for your explicit consent. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound to secrecy by virtue of the agreement between them and us, or an oath or legal obligation.

Automatically collected data

Data collected automatically by our website is processed with the aim of further improving our services. This data (e.g., your IP address, web browser, and operating system) is not personal data.

Cooperation in tax and criminal investigations

In some cases, Shades Concepts may be obliged by law to share your data in connection with tax or criminal investigations by government authorities. In such a case, we are compelled to share your data, but we will oppose this within the possibilities offered by law.

Retention periods

We retain your data for as long as you are our client. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you notify us of this, we will also interpret it as a request to be forgotten. Based on applicable administrative obligations, we must retain invoices with your (personal) data, so we will keep this data for as long as the applicable period runs. However, employees will no longer have access to your client profile and documents we have prepared as a result of your order.

Your rights

Based on applicable Dutch and European legislation, you, as the data subject, have certain rights regarding the personal data processed by or on behalf of us. Below, we explain what these rights are and how you can exercise them. In principle, to prevent misuse, we only send transcripts and copies of your data to the email address already known to us. In the event that you wish to receive the data at a different email address or, for example, by post, we will ask you to identify yourself. We maintain a record of processed requests; in the case of a request for erasure, we store anonymized data. You will receive all transcripts and copies of data in the machine-readable data format that we use within our systems. You have the right at all times to lodge a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data incorrectly.

You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data to the email address known to us, along with an overview of the processors holding this data, stating the category under which we have stored this data.

You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address known to us that the data has been adjusted.

You always have the right to restrict the data we process (or have processed) that relates to your person or can be traced back to it. You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data we process (or have processed) that relates to your person or can be traced back to it, carried out by another party. You can submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you, to the email address known to us, copies or duplicates of all data about you that we have processed or that has been processed by other processors or third parties on our behalf. In such a case, it is highly likely that we will no longer be able to continue providing services, as the secure linking of databases can no longer be guaranteed.

Right to object and other rights

Where applicable, you have the right to object to the processing of your personal data by or on behalf of Shades Concepts. If you object, we will immediately cease data processing pending the handling of your objection. If your objection is well-founded, we will make copies of data that we process (or have processed) available to you and then permanently cease processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Cookies

Google Analytics

Cookies from the American company Google are placed via our website as part of the “Analytics” service. We use this service to track and receive reports on how visitors use the website. This processor may be obliged, on the basis of applicable laws and regulations, to provide access to this data. We have not allowed Google to use the obtained analytics information for other Google services.
